Terms and Conditions
Mindbar offers Therapy Classes and 8-week deep-dive Series (collectively, “Services”) that are educational and wellness-focused. Mindbar Services may be accessed through the Platform online, and/or at in-person at designated locations.
Mindbar Services are not a substitute for individual psychotherapy, formal group therapy, or medical treatment for mental illness. Mindbar Services are educational and wellness-focused, with elements of classroom learning, group discussion, demonstrations, guided visualizations and workshops. Mindbar Services should not be considered medical advice; please contact your medical professional if you have questions about mental illness diagnosis or treatment.
Mindbar Services are not therapy, psychotherapy, or group therapy. Mindbar Services are intended to be educational and promote holistic wellness by teaching new skills and tools for managing anxieties and stressors associated with everyday life: work, relationships, health, self-care, etc.
Texas State law requires us to inform you that in certain cases your confidentiality is not protected, and your information may be disclosed to the appropriate authorities/agencies. These cases are: 1. If Mindbar management or teachers have reason to believe that you may harm yourself or others, 2. If Mindbar management or teachers have reason to believe that you are involved in or have knowledge of abuse or neglect of a child; or abuse, neglect, or exploitation of a person who is elderly or has a disability, or 3. If Mindbar management or teachers are ordered to disclose by State or Federal courts.
Mindbar Services are delivered by MindBar Teachers (“Teachers”) who may be licensed therapists or coaches, or other licensed or unlicensed specialists in various fields. Mindbar’s Teacher profiles (see www.mind-bar.com/teachers ) indicate each Mindbar Teacher’s type of licensure where applicable, provide a brief bio and a link to the Teacher’s own professional website. Mindbar Teachers are Independent Contractors, and are not employees, agents or representatives of Mindbar LLC. Mindbar performs background checks on all of its Teachers. Mindbar does everything in its power to ensure a safe, high-quality educational and healthful experience.
Mindbar Teachers cannot advise on mental health diagnoses or medical treatment, and cannot provide official documentation for any purposes including court-ordered counseling or support for disability accommodations.
Please let your Mindbar Teacher or other Mindbar staff know if you would like help in finding a therapist or psychiatrist. Mindbar neither promotes nor prevents Members from seeking individual counseling with Mindbar Teachers who are licensed therapists.
Teachers who are licensed therapists may self-refer, taking on Mindbar Members as their own individual therapy clients. In this case, it is the sole choice of the Mindbar Member to engage the Mindbar Teacher in their outside capacity as an individual provider. Mindbar does not benefit financially or in any other way from Member referrals to either outside professionals or to Mindbar Teachers.
If you have any questions, concerns or complaints regarding a Mindbar Teacher, the Mindbar Platform, Mindbar Services, Mindbar Content or other Mindbar Members, please contact Mindbar management and we will strive to address your needs.
You agree to provide accurate, truthful and complete information in filling out Mindbar forms and applications, and to keep this information up-to-date as applicable.
You agree to treat Mindbar Teachers, Staff and Members with respect and politeness, during online and in-person interactions, avoiding any behavior or language that would constitute harassment, including sexual harassment, and avoiding abusive, threatening, vulgar, obscene or racist language.
Mindbar Services are available only to individuals who are eighteen (18) years of age or older.
You agree to use only means of payment (e.g. credit cards, etc.) for which you are expressly authorized to use.
You agree to pay and not dispute any elected monthly recurring membership automatic charges on your account in accordance with Mindbar’s cancellation policy, which requires notice given via email to email@example.com at least 7 days prior to auto-renewal for cancellation. Partial refunds are not given; cancellations are effective at the end of the current paid month of Services.
MindBar may suspend or terminate your access to Mindbar’s Platform and Services at any time, for any reason or for no reason at all. MindBar has the right (but not the obligation) to refuse to provide access to the Service to any person, agency or organization at any time, for any reason or for no reason at all, in our sole discretion. MindBar reserves the right to change, suspend, or discontinue all or part of the Service, temporarily or permanently, without prior notice.
You affirmatively consent to the fact that MindBar Management will, as needed, record and review Therapy Class or Series Recordings (zoom) in which you are a participant, using HIPAA/HITECH approved de-identified methodology for the following purposes:
To periodically ensure Content quality and Teacher-adherence to Mindbar policies and methods
To review any complaint about a Teacher or another Member in your Therapy Class or Series
You consent to MindBar using "Meta Data" and other search terms to scan only HIPAA ‘Safe Harbor” de-identified transcripts of Therapy Class or Series recordings to search for trends and patterns that may affect the quality of the Services provided to you or the practices of the Teachers.
All de-identified data, meta-data and research data collected by MindBar through your use of the Services remains the sole property of MindBar. MindBar may share some or all of this research data with third parties in connection with joint or outside research, analytics, or similar purposes. Research data is used in non identifiable aggregate form, that is, as a statistical measure, but not in a manner that would identify you personally. You shall not request that MindBar remove or delete any of such data.
Any dispute or claim relating in any way to your use of MindBar Services will be resolved by binding confidential arbitration, rather than in court. The Federal Arbitration Act and federal arbitration law apply to these Terms.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must interpret these Terms as a court would.
It is agreed that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, MindBar and you each waive any right to a jury trial. It is further agreed that you may not bring suit in court to enjoin infringement or other misuse of intellectual property rights.
